Kicking Substance Abuse and Keeping Your Security Clearance

A legal guide to keeping a security clearance after substance abuse treatment or a DUI under Guideline G and H.

Substance abuse—whether involving alcohol (Guideline G) or drugs (Guideline H)—is one of the most common challenges for security clearance holders. The question is not just "Can I keep my clearance?" but "How do I demonstrate the stability and judgment required to protect national security?"

Guideline G: Alcohol Consumption
The government is concerned with alcohol use that leads to impaired judgment or criminal conduct (like a DUI). To mitigate these concerns, an applicant must show:

Completion of Treatment: Successful participation in a recognized rehabilitation program.
Abstinence or Controlled Use: Evidence of a stable, long-term change in behavior.
Support Systems: Involvement in programs like Alcoholics Anonymous (AA) or ongoing counseling.

Guideline H: Drug Involvement & The Marijuana Gap
In 2026, the most frequent Guideline H issue is the use of marijuana in states where it is legal. Federal law still prohibits marijuana use, and "I thought it was legal in my state" is not a valid legal defense.

Mitigation for drug involvement focuses on:
Frequency and Recency: How long has it been since the last use?
Disassociation: Have you cut ties with drug-using associates and environments?
A Pledge of Future Abstinence: A signed, credible statement promising never to use illegal substances while holding a clearance.

The Power of Self-Reporting
Under Continuous Vetting, the government will eventually find out about an arrest or a positive test. Reporting the issue yourself and immediately seeking treatment shows the high level of "candor" and "judgment" that adjudicators look for under the Whole Person Concept.
